Daniel J. Nichols graduated from the University of South Dakota with degrees in Political Science and History.
Law School and Real Estate Commission.
In 1978, Dan graduated from the University of South Dakota School of Law. Upon graduating, Dan served as legal counsel for South Dakota Real Estate Commission, in Pierre, South Dakota.
Practicing in Sioux Falls.
Since 1982, Dan has been in the private practice of law in Sioux Falls, South Dakota. At Nichols & Rabuck, P.C., Dan is a senior partner. Dan has also served on the South Dakota Board of Pardons and Parole, including holding the position of Chairman of the Board from 2000-2001.
Areas of Practice.
With a background in real estate law from working for the South Dakota Real Estate Commission in Pierre, Dan does a significant amount of property law. Dan has successfully litigated real estate cases before the South Dakota Supreme Court. In addition to assisting clients with real estate matters, Dan also practice in the following areas:
Family Law – Dan has handled various divorces, custody and child support cases, and adoptions.
Contract Law – Dan has drafted and negotiated hundreds of contracts of various natures, including preparing business agreements; Dan has also litigated contract disputes.
Trusts, Wills and Probates – preparing wills, powers of attorney, living wills, living trusts and other estate planning documents is an area Dan is proficient in. He has also successfully probated numerous estates and has litigated probate and will disputes.
Business Law – Dan has organized hundreds of partnerships, corporations, LLC’s, LLP’s, and non-profit corporations. In addition to strategic formation, Dan represents entities and businesses of all sizes as they grow and change, from mom-and-pops to multi-million dollar corporations.
Criminal Misdemeanor – While Dan is mostly known for his business and family law experience and expertise, he also has a knack for defending the accused, as Dan is satisfied to keep figures of authority in check of the law. He knows the law and is skilled in procedure.

Dan was born on September 7, 1953
in Sioux Falls, South Dakota. He attended Garfield, Lincoln, and
Cathedral Elementary and Axtell Park Middle School in Sioux Falls. Dan graduated from Sioux Falls Washington High School in 1971. Today he lives in his home town of Sioux Falls, where he enjoys the local golf courses (especially Elmwood) and watching football with his brothers and sisters.
