Growing up in Sioux Falls.
Jack J. Nichols was born and raised in Sioux Falls, South Dakota. Jack attended St. Mary's elementary school, O'Gorman Jr. High School, and O'Gorman High School.
As an Undergraduate.
Jack attended the University of South Dakota and graduated summa cum laude with a degree in History and a minor in German.
Law and Business School.
From 2009-2012 Jack studied both law and business at Creighton University in Omaha, Nebraska. While studying both law and business, Jack clerked at First National Bank of Omaha, the largest privately owned bank in the United States. While at First National Bank of Omaha, Jack worked in the litigation department located in the First National Tower, downtown Omaha. Jack graduated cum laude with a JD and MBA from Creighton in 2012.
A Career in the Law.
Upon graduating, Jack began practicing law with Lindquist & Vennum, LLP as a business and M&A attorney. Jack passed the South Dakota bar exam, and achieved a score sufficient to waive into Minnesota, and today he is licensed in both states. Jack joined Nichols & Rabuck in January of 2014, where he has expanded his practice areas to include more family law and estate planning in addition to business law.
A Rising Star.
Jack was selected to the 2014 Rising Stars list. Each year, no more than 2.5 percent of the lawyers in the state are selected by the research team at Super Lawyers to receive this honor. Super Lawyers, a Thompson Rueters Business, is a rating service of outstanding lawyers from more than 70 practice areas who have attained a high degree of peer recognition and professional achievement. Jack focuses on business law, family law, and estate planning. Some specific areas of his practice include:
Business Formation – Jack advises clients in the process of incorporation and LLC formation and crafts personalized bylaws and operating agreements, as well as other necessary documents, to address the particular issues of each business client. Jack drafts, reviews, and negotiates agreements, purchases, and sales. Jack assists clients with terms negotiation, due diligence, and other issues in the buying and selling of businesses.
Family Law – Jack assists clients with family issues as they occur, including custody and visitation disputes.
Cyberlaw - More issues are emerging from the growing use of the internet, with respect to domains, intellectual property, and contract issues. Jack keeps informed about these developing issues in order to advise clients as they expand their businesses and personal lives into the internet.
Digital Assets & Social Media – Jack assists clients with the legal issues associated with social media and digital assets, from the buying and selling of businesses, to employment policies, to solutions for social media and digital assets in the realm of trusts and estates.
Litigation – Jack assists clients when disputes arise, including breach of contract issues and negligence claims.
Estate Planning and Probate – Jack creates estate plans catered to the needs of his clients, from simple estates to large and complex ones. Jack focuses on asset preservation, legacy, family values continuation, and proper treatment of social media and digital assets in an estate plan.
Trademarks – Jack assists clients with issues related to their brands, names, and trademarks, including registration and conflict resolution.
Bankruptcy -- Jack helps debtors who are in over their heads obtain debt relief in South Dakota Federal Court through Chapter 7 and Chapter 13 bankruptcies.
DUI / DWI -- Jack assists those charged with driving under the influence in violation of South Dakota law. Jack thoroughly analyzes the prosecution's case for flaws and weaknesses in order to either try to case or negotiate a fair deal.

In his free time, Jack enjoys playing Sioux Falls recreation league sports. Jack likes to read up on history and economics, his two favorite non-legal subjects. Jack is a continuing student of the law and enjoys classical legal annals, as well as any textbook or podcast he can get his hands on. Jack also spends a great deal of time watching professional sports, especially NFL football and Minnesota Twins baseball.
